Mandatory
Agency
Disclosure - “Agency
Relationships”
When was the last time the auto
salesperson was working for you? They are employed by the
dealership, not you, and work for the financial interest of their
employer. Whether you are buying or selling, you can choose to have
the advice, assistance and representation of your own agent. Do not
assume that a Realtor®
is acting on your behalf.
The Massachusetts Board of
Registration of Real Estate Brokers and Salespersons requires that a
mandatory agency disclosure be presented at the first personal
meeting you have with an agent to discuss any property.
This is not a contract;
it is a disclosure to clarify the agency relationships. It enables
you the consumer to make an informed decision, if you wish to make
one, before working with a real estate licensee.
Never assume that a Realtor®,
or any real estate salesperson, is representing your best
interests---unless they are contractually obligated to do so.
By entering a contractual
agreement, whether with a sellers or buyers agent, your agent will
have a fiduciary responsibility to you, working in your best
interest.
